1. Who we are

Loakal is a map of Belizean businesses and their offers, run by:

2. Words we use

• Visitor: anyone who uses Loakal to find businesses or offers.
• Owner: anyone who creates or manages a listing.
• Listing: a business on Loakal.
• Offer: a deal or event a listing posts, for a set of days.
• Content: anything you put on Loakal: words, photos, hours, contact details and offers.

3. Accounts

You must be 18 or older to create an account. To list a business you must own it, or be allowed by its owner to list it. One account can manage up to three listings.

You are responsible for keeping your account safe and for what is done with it. Tell us at once if you think someone else has got into it.

4. What Loakal is, and what it is not

Loakal is a directory. We are not part of anything that happens between you and a business you find here.

• We check that a listing’s pin is where the business is, and a moderator reviews every listing before it goes live. We do not check the quality, safety, licences or prices of any business.
• We do not recommend or guarantee any business, product or service.
• Any purchase, booking or dispute is between you and the business.
• Owners write their listings. Hours, prices and offers change, and businesses close: confirm what matters with the business.

5. Listings

What you promise

When you send a listing for review, you confirm that:

• you own the business or are allowed to list it;
• what you write is true and up to date;
• you own the photos, or have permission to use them;
• the business operates lawfully in Belize, with any licence it needs;
• the location you confirm is where the business really is.

Keep your listing current, above all your hours and contact details.

Checking the location

To show a business at a place, you confirm its location by standing at the business with your phone and sharing your position once. If that cannot be done, we may ask for photos instead. We may ask you to check the location again at any time.

Review

A moderator reviews every listing before it goes live, usually within a few days. We may send a listing back with what to fix, decline it, or later edit, pause or remove it, for example when it breaks these terms, when we receive a credible report, or when its details look wrong. Approval is not an endorsement.

6. Offers

Offers are included with your listing while its trial or plan is running. There is no limit on how many you post. An offer must:

• give customers a real, specific benefit, or describe a real event;
• have a first and a last day, at most 60 days apart;
• be honoured, on the terms shown, for every day it runs.

You may post an offer up to 30 days before its first day; it shows from when you post it and says when it starts. A slogan or your normal prices is not an offer. We decide the order offers appear in, and do not promise any number of views. We may take down an offer that breaks these rules, and repeated breaches may pause your listing.

We may later offer paid ways to promote a listing or an offer. They will always be optional, and we will show the price before you buy.

7. Your content

You keep ownership of what you upload. You allow us, without payment and worldwide, to store, copy, resize, adapt and show it to run and promote Loakal, while it is on Loakal and for a short time afterwards while backups and caches clear.

Do not upload anything that:

• breaks someone else’s copyright, trademark or privacy;
• is false or misleading;
• is unlawful, obscene, harassing or discriminatory;
• contains malware or tries to interfere with Loakal;
• pretends to be another business or person.

8. Trial, plan and payment

The free trial

A new listing gets a 60-day free trial, starting the day it goes live, not the day you sign up. You do not give any payment details for it.

The plan

Prices are in Belize dollars. Your invoice shows any tax that applies. Registered charities and non-profit organisations can ask for their listing to be free; we decide each request.

Paying

We email you an invoice, which you pay by bank transfer as it describes. We do not take cards, and nothing is ever charged automatically: you pay only invoices you choose to pay. Your plan runs for the month or year the invoice covers, from when the trial or your last period ends.

If a plan is not paid

When a trial or paid period ends, you have 7 days to pay, and the listing stays as it is. After that it stays on the map with its details and photos, but its offers stop showing and it may lose its Verified mark. Paying at any time restores it.

Cancelling and refunds

You can stop at any time by not paying the next invoice, or by deleting your listing. A month that has started is not refunded. If you pay for a year and ask for a refund within 14 days of paying, we refund it in full; after that, the year is not refunded. If we remove your listing without good reason during a paid period, we refund the part not used.

Price changes

We may change prices. A change applies from your next period, and we will tell you before we invoice you at a new price.

9. Fair use

Do not:

• list a business you do not own or represent;
• give false information, including a false location;
• open more accounts to get around a limit;
• copy, scrape or bulk-download the directory;
• try to get into parts of Loakal you are not allowed into, or interfere with it;
• use Loakal to send spam;
• post offers you do not mean to honour.

10. Reports

Anyone with an account can report a listing or an offer. We review reports and may take an offer down, pause a listing or close an account. We never tell a business who reported it. Someone who keeps sending false reports can be stopped from reporting.

11. Closing an account

You can delete your account at any time from Your account. That deletes every listing only you manage; a listing someone else also manages stays, without you.

We may suspend or close an account that breaks these terms, when the law requires it, or when it puts others at risk. Unless the breach is serious, we will warn you first.

12. Availability

We work to keep Loakal running but cannot promise it always will. We may pause it for maintenance, and add, change or remove features. Loakal is for Belize.

13. Map data

Map data © OpenStreetMap contributors, available under the Open Database Licence.

14. Our name and software

The Loakal name, logo, software and design, and the directory as a whole, are ours. These terms let you use Loakal as intended, nothing more.

15. Liability

As far as Belize law allows:

• Loakal is provided as it is and as available, without promises of any kind;
• we are not responsible for any loss from your dealings with a business on Loakal;
• we are not responsible for indirect losses, or for lost profit, income, goodwill or data;
• our total responsibility to an owner in any 12 months is limited to what you paid us in that time.

Some rights can’t be limited by a contract, such as your rights under Belize’s consumer protection laws, or responsibility for fraud or for harm caused by negligence. Nothing in these terms limits those.

16. Indemnity

If someone makes a claim against us because of your content, your listing, your offers or your breach of these terms, you agree to cover our reasonable losses and legal costs.

17. Changes

We may update these terms. We will post the new version here with a new date and version, and tell you by email or on Loakal before a change that affects your rights takes effect. Using Loakal after that means you accept the new terms.

18. Law

These terms are governed by the laws of Belize, and the courts of Belize decide any dispute.

19. General

If part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not giving it up. You may not pass your rights under these terms to someone else without our agreement; we may pass ours on if Loakal is sold or reorganised.
